Recently, various management companies and homeowners' associations have often contacted our company, wanting to purchase metal bins. In the future, these boxes are installed at the entrances. This is due to the fact that the Novosibirsk prosecutor's office checks all apartment buildings for compliance with rules and regulations.

The maintenance of the local area is regulated by Decree of the Government of the Russian Federation of April 3, 2013 N 290 (as amended on February 27, 2017) “On the minimum list of services and works necessary to ensure the proper maintenance of common property in apartment building, and the procedure for their provision and implementation”, “Rules for the provision of services and performance of work necessary to ensure the proper maintenance of common property in an apartment building” and Resolution of the Gosstroy of the Russian Federation dated September 27, 2003 N 170 “On approval of the Rules and norms for the technical operation of the housing stock”.

In accordance with the regulations, each entrance must be equipped with a bin for collecting garbage, periodically employees of the Criminal Code or Homeowners' association must clean the bins and rinse them. With regard to the materials from which the urns are made, the rules do not establish any restrictions on the material from which the urns are made. However, as a rule, the UK and HOA opt for metal bins, since they are more budgetary in cost and lighter than concrete bins in weight.

Not uncommon for residents apartment building questions arise regarding the placement of shops near the entrance of an apartment building. It happens that not only noisy young people gather on these benches in the evening and at night, but also those who like to drink strong drinks and smoke. In this situation, the owners quite rightly have a desire to dismantle the benches near the entrance, with a request for which they turn to the managing organization.

A more extended composition of common property is contained in Art. 36 of the Housing Code of the Russian Federation, owners of premises in an apartment building own, on the basis of common shared ownership, premises in this building that are not parts of apartments and are intended to serve more than one room in this house, including inter-apartment landings, stairs, elevators, elevator and other shafts , corridors, technical floors, attics, basements in which there are engineering communications, other equipment serving more than one room in this house (technical basements), as well as roofs enclosing load-bearing and non-bearing structures of this house, mechanical, electrical, sanitary and other equipment located in this house outside or inside the premises and serving more than one room, the land plot on which this house is located, with landscaping and landscaping elements and other objects intended for maintenance, operation and improvement of this house located on the specified land plot . Borders and size land plot, on which the apartment building is located, are determined in accordance with the requirements of land legislation and legislation on urban planning.

The owners of premises in an apartment building own, use and, within the limits established by this Code and civil legislation, dispose of the common property in an apartment building. Reducing the size of common property in an apartment building is possible only with the consent of all the owners of the premises in this house through its reconstruction.

In accordance with paragraph 3 of Art. 17 of the Constitution of the Russian Federation, the exercise of the rights and freedoms of man and citizen must not violate the rights and freedoms of other persons.

The bench, located near the entrance and under the windows of the dwelling, refers to the elements of improvement of the adjacent land plot, which is in common ownership of the owners of the premises of the apartment building.

Respectively making a decision to dismantle the shop does not fall within the competence of the governing body. The decision to reduce the common property (dismantle the shop) of an apartment building must be made at a general meeting of owners of the premises of an apartment building on the basis of Part 2 Art. 44 of the Housing Code of the Russian Federation.

It should be noted that according to paragraph 2.13 of SNiP 2.07.01-89, when designing residential development, it should be provided for the placement of recreation areas for the adult population with a specific size of 0.1 sq.m. at a distance of 10 meters from the sites to the windows of residential and public buildings.

However, this SNiP does not extend its effect and does not impose an obligation on the managing organization to dismantle the bench, equipped according to the design decision during the construction of the building and which is part of the common property.

According to the preamble of this SNiP, these rules and regulations apply to the design of new and reconstruction of existing urban and rural settlements and include the basic requirements for their planning and development.

At the same time, the effect of these building codes and rules also applies to the owners of the common property of an apartment building, who are obliged to comply with it. The implementation of this SNiP is possible only with the appropriate decisions of the owners.

The foregoing indicates that the managing organization is not entitled to independently dismantle the benches near the entrance apartment building without the decision of the tenants.

Decree of the Cabinet of Ministers dated October 2, 2018 No. approved the Rules for the placement and operation of infrastructure facilities for sanitary cleaning and household waste management.

The document reflects the procedure for handling household waste, taking into account the specifics of their types (large-sized, construction, vehicle waste, hazardous waste, etc.), as well as the collection, transportation and disposal of waste.

The following points deserve special attention.

Secondly introduced requirements for the urns themselves and their use. Stationary outdoor litter bins must be of a tilting mechanism and have a base to be securely fixed in place. And near trade pavilions (including mobile tents, stalls and trays), within a radius of up to 5 m, portable urns are placed or with removable buckets inside for emptying.

It is necessary to empty and clean the bins systematically as they are filled, but at least once a day, and rinse and disinfect at least once a month or use special garbage bags (bags).

Thirdly , the procedure for organizing waste collection points is outlined. They should be at least 20 m away from the windows of residential buildings, the boundaries of areas of children's institutions, places of rest, but not more than 100 m, and also be out of sight from transit transport and pedestrian communications, away from the street facades of buildings.

The area of ​​the waste collection point and the number of containers in it are determined in accordance with sanitary rules, norms and hygiene standards. However, the containers must be different in color for separate collection of waste and marked with special signs and inscriptions. In total, four types of mandatory containers and three more additional ones are provided ( see table below).

Compliance with the described requirements is under the constant control of the Inspectorate for Control over the Formation, Collection, Storage, Transportation, Disposal, Processing, Burial and Sale of Waste of the State Committee for Ecology and its territorial divisions. Where do the heavy metal boxes from the entrances go?

The beautification of the city is made up of little things. And in the literal sense: Muscovites began to complain about the lack of ballot boxes in the city. More than a hundred complaints have already been submitted to the well-known city portal. Some of them have an obvious fantastic connotation: dustbins appear at the entrances for a couple of months, and then disappear. "MK" figured out who is responsible for the ballot boxes in Moscow courtyards and whether they are needed at all near our entrances.

Near the entrances there are no trash cans at all! A huge number of people walk past the house to the subway and back. There is nowhere to throw garbage. They just throw it on the ground! - Natalia Yemelyanova, a resident of the house on Marshal Vasilevsky Street, complains.

And there are dozens of such messages about garbage where there should be a garbage can. Moreover, urns have a sad tendency to disappear. For example, Denis Pavlov, a resident of a house on Volgogradsky Prospekt, complains that the urn near the house has disappeared because it was not concreted. The same thing is happening on Dobrolyubova Street, on Leninsky Prospekt (“At the moment, out of six entrances, only one has a bin. It is not surprising that it is always overflowing and the garbage is scattered around”), on Rogova Street in Shchukin (“Our entrance was again deprived of a trash can! ”) and on many other streets.

At first glance, it seems that the urns in the capital began to disappear en masse. However, municipal deputies interviewed by MK said that there was no city-wide program to eliminate trash cans. As the municipal deputy of the Zyuzino district Konstantin Yankauskas explained to MK, for adjoining territory and ballot boxes like it is the responsibility of the State Budgetary Institution "Zhilischnik" districts.

If an urn has disappeared at the entrance, then the resident needs to contact this organization or the district council and ask for it to be returned, the mundep explained. - Why are the urns disappearing? Either they served their time, or someone dragged them away. They are sometimes stolen as an alternative smoking area.

By the way, the urn, the simplest, costs about 800 rubles. Who and why decided to cut down or dig out an ordinary piece of iron (even instead of an ashtray) is a big question.

Every year, a list of landscaping is formed in each district, Jankauskas says. - If the courtyard is included in this program, then, among other things, they can install a trash can at the entrance, on the playground and in other areas. This list, according to the law, is formed on the basis of appeals from residents, municipal deputies, acts of the OATI and on the basis of bypasses of the territory that are carried out by the council. If there are no clear appeals, then, as a rule, the project may not have what the residents need.

In practice, the situation is slightly different. Residents can write similar appeals for several years, ask to install at least an artificial surface on the playground, at least the same ballot box, but receive the same answer from the council: the list was agreed upon, your appeal was not included. Municipal deputies call the system for coordinating the addresses of improvement opaque. This seems to be true, since on the same city portal some of the relatively old complaints about certain areas (for example, about Kuzminki) remained unanswered.


Butyrsky became the leader in appeals among the districts. True, most of them are written by the same user...

According to a recent visit (the last one was on Saturday, November 3, with representatives of the council and the State Budgetary Institution "Zhilischnik"), in several yards, installation according to such applications led to the fact that the bins were placed near the entrances and "ate" one parking space ... - Marina Denezhkina, a municipal deputy of the Butyrsky district, told MK.

With a shortage of parking in the courtyards of Moscow, this is a real problem. You can carry a wrapper in your pocket, but you can’t put a car in your pocket... “Did they do good with their trash cans or not?” - the municipal deputy asks a rhetorical question. “They” are, most likely, people from the “Housing”. Perhaps the answer will be given by the decree of the Moscow government No. 1018 from 1999. Let us quote him: “At each entrance of residential buildings ... urns should be installed. Litter bins are installed at a distance of 50 m from one another on the streets of the first category, markets, train stations and other places of mass visitation of the population, on other streets, in yards, parks, gardens and other territories - at a distance of up to 100 m.

Apparently, in order to maintain the prescribed distance of 100 meters at the entrances, our communal services put the bins wherever possible or do not put them at all. But then they violate point number one...

By the way, Marina Denezhkina raised an old sore point: “Are bins really needed at each entrance?”

The ballot box can stand at a playground, - the deputy considers. - Near the entrance it is not needed. Firstly, we then protect the entrance itself from negative acts, which are called terrorist. Secondly, no one goes to the entrance to the apartment building to smoke.

The story of urns and terrorism is really relevant. However, Moscow, it seems, has not yet decided: does it want cleanliness near every house or not?

If our city is developing along the path of separate waste collection, then a separate bin at the entrance is clearly not a means to achieve this goal, - urbanist Petr Ivanov believes. - And then it must be removed, because anything can be thrown there. Even household garbage, if imperfect garbage chutes are conducive to this. In many homes, the waste chute does not open wide enough to fit a bag of trash in. And it’s easier to really get out of the entrance and throw your good into the trash. It's a question of the rules of the game. If we play separate collection, then we remove the bins and create garbage bins for this. Everything depends on city politics.

By the way, the capital is now trying to fight on two fronts: we seem to be for separate collection and ecology, but the bins are still our everything ... Meanwhile, in Moscow, in addition to projects for separate waste collection, transparent mesh containers are appearing for collecting empty plastic bottles. In particular, residents of the Chertanovo Central district noticed such containers in the yards on Varshavskoye Highway.

HOW ARE THEM?

After a series of terrorist attacks in the 1990s, the Paris authorities decided to abandon closed trash cans in favor of transparent bags with mounts. This garbage collection option allows you to quickly respond to suspicious items, although local residents immediately noticed that garbage bags disfigure the streets of the city. However, the practice has taken root - from Paris, such bags also migrated to Italy and Malta.

After the terrorist attacks of the 2010s, the French authorities discussed for some time the possibility of installing special heavy-duty urns that would keep the force of the explosion inside. However, this idea is very expensive, it has not yet received distribution.
