IV. Filling in the vertical columns must be done in compliance with the following requirements:

Column 7 "total" (the sum of columns 8 to 13) includes the number of reserved citizens who are in reserve. This number does not include booked citizens who are in reserve. The heads of all enterprises of the Russian Federation, regardless of their form of ownership, must keep and submit reports to the military registration and enlistment office (clause 6, clause 1, article 8 of the Federal Law “On Defense” dated May 31, 1996 No. 61-FZ). Employees of the state structure, accepting reports, verify the data provided with those contained in their databases. This procedure helps to control the conscripts in the Russian Federation.

Organizations should submit a report on those liable for military service to the military registration and enlistment office at the location of the organization. As for individual entrepreneurs, entrepreneurs are not required to keep military records (clause 6, article 8 of the law of May 31, 1996 No. 31-FZ, clause 7 of article 8 of the law of March 28, 1998 No. 55-FZ).

What forms to submit and when

In paragraph 29 of the Guidelines for maintaining military records in organizations, approved. On July 11, 2017, the General Staff of the Armed Forces of the Russian Federation indicated which reports are submitted by the persons responsible for this part of the work. Among them is the requirement at least once a year to submit information in form 18 and a report on the number of employed and booked citizens in a new form 6 detailing employees by category. Deadline - until December 31 of the current year as of January 1 of the next year.

If the organization does not work on booking and there are no citizens who are in reserve, she does not need form 6, she reports on form 18. Some commissariats require a certificate to be provided not only at the end of the year, but also in the following cases:

  • change of the head of the enterprise;
  • appointment of a new person responsible for military registration;
  • changes to the organization's address and credentials;
  • changes in the number of citizens in the reserve.

How to fill out reports on forms 18 and 6

All reports on military registration in the organization are filled out taking into account information from the personal cards of employees (unified forms No. T-2 GS (MS) and No. T-2) and registration data of the organization. The responsible person will need three copies:

  • one remains in the organization;
  • two are sent to the military registration and enlistment office. The military enlistment office prepares one of the documents for the city council's booking committee.

Fill out the forms by hand or electronically, it is acceptable to print on both sides of one sheet.

Please note: unlike other reporting, all documents to the military registration and enlistment office are formed only in paper form and with “wet” seals. In the Russian Federation, there is a special automated control system "Zarnitsa-M", but it is used infrequently. Therefore, carefully check all the data before transferring them to the military registration and enlistment office.

Reports to the military registration and enlistment office resemble statistical ones:

  • No. 18 contains the details of the organization and general quantitative information about those liable for military service;

Form 18

Let's start with a report in form 18 - an enterprise card for the military registration and enlistment office. The form itself was previously approved by the Methodological Recommendations of the General Staff, but it is no longer in the recommendations of 2017. However, there is a Letter of the Ministry of Culture of October 21, 2015 No. 344-01-39-VA and an Order of the Judicial Department under the Supreme Court of the Russian Federation of May 13, 2019 No. 95, where such a form is presented. Forms and the procedure for filling them out are also published on the official websites of local governments.

We start filling from the date as of which we report. If this is at the end of the year, then we indicate 01/01/2020. If the reasons for submitting the report are different, indicate the date of the changes. But we recommend that you clarify the date of issue of the card at the commissariat so that there are no problems, since differences are acceptable in different regions.

In paragraphs 1-3, we indicate the full name of the organization, information about the head and the person responsible for military registration at the enterprise. If there are several of them, it is permissible to enter several surnames or limit yourself to information about the head of the unit.

In order not to make a mistake in paragraph 4, check the information in the accounting department or administration. It requires the date and place of registration as a legal entity.

The data in paragraphs 5-7 (legal, actual and postal addresses) sometimes coincide. In this case, write the same data, but do not leave empty lines.

Item 8 is filled in if the organization is state (municipal), and there is a higher structure above it. When the report is compiled by private companies, they put dashes.

In the tabular part of the report from paragraph 9, enter the data from the registration documents. If in doubt, they should be clarified.

If the military commissariat or the district commission has requested from the organization an organization registration card in form No. 18, it can be submitted in the form approved by the Letter of the Ministry of Culture dated 10.21.2015 No. 344-01-39-VA. How to fill out an organization registration card

The procedure for filling out the organization's accounting card is given in Appendix No. 2 to the Letter of the Ministry of Culture of October 21, 2015 No. 344-01-39-VA.

It is noted that the organization's accounting card is filled out on two sides of an A4 sheet.

Clause 4 of the card indicates the last date of registration (re-registration) of the certificate of entry in the Unified State Register of Legal Entities, the full name of the tax authority that issued the certificate, as well as the series and number of this certificate.

When specifying the total number of all employees of the organization in clause 10 of the card, employees registered in combination are not taken into account. In this case, the value in clause 10.1 is determined as the sum of the values ​​in clauses. "a" and pp. b of this paragraph.

Which of the employees should keep military records in the organization

The head of the organization is responsible for the state of military registration in the organization (clause 6, article 1 of the Law of March 28, 1998 No. 53-FZ, clause 9 of the Regulations approved by Decree of the Government of the Russian Federation of November 27, 2006 No. 719). He may appoint an officer responsible for military registration work. For this, an order is issued. Which employees are not subject to military registration

Military registration documents

Keep military registration on the basis of military registration documents. They must be presented by citizens when applying for a job. The fact that women belong to the category of citizens liable for military service is confirmed by the stamp in the passport. This follows from paragraphs 28 and 49 of the regulation approved by Government Decree No. 719 dated November 27, 2006.

Is it possible to refuse to hire a person who has not presented documents of military registration

No. Citizens liable for military service or conscripts present military registration documents when applying for a job. If there are no documents, the organization itself is obliged to request information about the status of the employee for the purposes of military registration (part 1 of article 65 of the Labor Code, decision of the Supreme Court of November 19, 2009 No. GKPI 09-1351).

There are no provisions in the Labor Code prohibiting the employment of citizens without military registration documents. If you refuse to hire such an applicant, you violate his labor rights (Articles 3 and 64 of the Labor Code).

About hiring an employee who did not present military registration documents, inform the military registration and enlistment office. If the organization fails to fulfill this obligation, this may lead to administrative liability (subparagraph “a”, paragraph 32 of the provision, approved by Government Decree No. 719 of November 27, 2006, part 3 of article 21.4 of the Code of Administrative Offenses).

From February 17, 2019, employers have new obligations provided for by the Federal Law of February 6, 2019 No. 8-FZ, which amended the law on military duty and military service. The form of referral to the military commissariat for military registration was approved by a joint order of the Ministry of Defense, the Ministry of Internal Affairs and the Federal Migration Service (.rtf 287 Kb) . What report on military registration must be submitted before 08/25/2020. On the admission and dismissal of an employee who is subject to military registration, the employer is obliged to notify the military commissariat and (or) local authorities within two weeks (subparagraph “a”, paragraph 32 of the Regulation, approved by Decree of the Government of the Russian Federation of November 27, 2006 No. 719 ).

Military commissariats check the maintenance of military records in organizations. Such inspections are carried out once a year for organizations with more than 500 employees and at least once every three years for employers with fewer employees.

During the inspection, the military commissariats establish:

  • complete coverage of citizens by military registration;

  • the completeness and reliability of the data contained in the personal cards of people subject to military registration;
  • organizing and ensuring the fulfillment by citizens of duties on military registration, the fulfillment by officials of organizations of the requirements of legislation on military duty and military registration.

The military enlistment office communicates the results of checks to the heads of organizations and reflects them in the logs of checks on the implementation of military registration, which are conducted in military commissariats (local governments) and in organizations. The form of the journal was approved by order of the Russian Ministry of Defense dated July 18, 2014 No. 495.

If serious shortcomings are identified in the maintenance of military records by organizations, military commissars report this to the military commissariats of the constituent entities of the Russian Federation and a higher authority that has jurisdiction over the organization being inspected (if any). Do entrepreneurs need to keep military records of employees?

An entrepreneur is not required to keep military records (subparagraph 6, paragraph 1, article 8 of the Law of May 31, 1996 No. 61-FZ, paragraph 7 of Article 8 of the Law of March 28, 1998 No. 53-FZ).

At the same time, he, like other employers, must request military registration documents from persons entering work (part 1, part 3, article 11, part 4, article 20 of the Labor Code of the Russian Federation).

However, responsibility for not reporting the admission of employees without military documents is provided only for organizations (). PENALTY for violation of the procedure for maintaining military records

For failure to submit within the prescribed period to the military commissariat or to another body that carries out military registration, lists of employees subject to initial military registration, a fine in the amount of 300 to 1000 rubles is imposed. ().

In addition, the order of the Ministry of Finance dated July 2, 2010 66n clearly lists all receipts that should be included in the report on the intended use of funds. Therefore, if the business does not have such expenses, it may choose not to complete this form. At the same time, any funds from any sources must be accountable, including amounts from membership fees or voluntary donations, as well as funds not used during the reporting period.

The report is drawn up according to the uniform form No. 6 approved by the Ministry of Finance of the Russian Federation in Order 66n dated July 2, 2010 (code 0710006). Although, if desired, the enterprise has the right to draw up its own form, more suitable for the characteristics of its activities, but in accordance with the requirements of the law.

All items in the form are required to be completed. Filling out the report is quite simple, the title of each of its sections speaks for itself. First, you need to fill in the introductory part of the document, the details of the organization fit into it. Further information is entered into sections.

Structure

The Form 6 report consists of the following items:

  • "Opening balance". The target receipts in the form of monetary amounts or from the results of the main activities that took place by the beginning of the reporting period and by the end of the previous one are taken into account in full.
  • "Funds received." This item requires you to enter information about:
    • funds received from the main commercial activity of the enterprise;
    • funds received from;
    • receipts in the form of state subsidies;
    • all membership, entrance or other fees.
  • "Funds used". This section reflects all costs with specific goals:
    • targeted expenses, for example, for charitable events, meetings, seminars;
    • on the administrative apparatus, maintenance and repair of buildings and fixed assets;
    • travel expenses;
    • on, equipment and other means;
    • other expenses.
  • "Balance at the end of the year". The balance at the beginning of the period is reflected from earlier receipts, that is, all funds not spent by the beginning of the period. If the balance is negative, that is, the expenses exceeded the funds available to the enterprise, then its amount is placed in parentheses and with a detailed statement of the reasons for the occurrence of such situations, which must be attached to the document.

After filling out the form is certified and stamped. The date of preparation of the document must be indicated. Then it is attached to the main package of reporting documentation. This form should be sent to the tax office along with the annual report, to the statistical authorities, and it can also be received by all interested parties, including those from whom the enterprise received targeted funds.
